Judge Orders Vote in West Seneca

Buffalo, NY (WBEN)- A petition drive led by area attorney leader Kevin Gaughan has been validated by State Supreme Court Judge Joseph Mintz.

Despite objections from the Erie County Board of Elections, Judge Mintz ordered that a referendum offering a downsized town board be completed by mid-November. 

"This is a victory for every Western New Yorker who seeks to re-gain control over their local government, " Gaughan said.

Based on a technicality, the Erie County Board of Elections had ruled the petitions calling for the vote invalid.

But the man leading the charge, local regionalism advocate Kevin Gaughan, didn't give up. Gaughan doesn't believe the board of elections should have ruled rather the West Seneca town clerk. "We will take whatever steps are necessary" says Gaughan adding "these folks are always interested in a fight and if its a fight that they want then they'll get one from me."    

Gaughan believes he will be successful when all is said and done, and he's launched a similiar effort in the town of Amherst.
