Buffalo, NY (WBEN) Lawyers for Pinnacle Charter School will present their arguments to Judge John Michalek Tuesday afternoon to keep the doors open.
Justice John A. Michalek declined to act on papers filed for a temporary restraining order without a hearing and scheduled arguments for next Tuesday at 2 p.m. Pinnacle board of trustees members will meet again with state education representatives.
This all stems from an August 26th announcement by the state that representatives would be at the school to discuss closing procedures. That sparked the latest court effort. Back in April 2012 a vote by the New York State Board of Regents not to renew Pinnacle's charter for the 2012-13 school year due to a downturn in scores on state-mandated proficiency tests started the legal fight. The school has remained in operation under a ruling by State Supreme Court Justice John A. Michalek barring closure of the school as Pinnacle lawyers fought the Regents’ decision.
