State officials explain gun-control law in Clarence

Clarence (WBEN) -- Several gun owners packed into the meeting room and hallway at the Clarence Library for the state's noon-time presentation on the NY SAFE Act -- the new gun control law.

The speakers included Mike Green, executive deputy commissioner of the state Division of Criminal Justice Services, and Steve Hogan, first deputy  counsel of the New York State Police.

The two were often interrupted during their presentation, with one heckler calling out "Cuomo for President," and  others trying to stop the presentation with a group recitation of  the Pledge of Allegiance.   At other times, loud guffaws and mock laughter filled the room, despite the presenters efforts to limit debate on the substance of the gun law.

A gun advocacy group took the first legal step Tuesday toward halting the newly-signed gun laws in New York state.

With the aid of Buffalo area attorney James Tresmond, a notice of claim - the first step in suing any government- was filed Tuesday by the New York Rifle and Pistol Association.

“We believe that (Gov. Andrew) Cuomo’s gun law is a blatant infringement on our Second Amendment rights,” said Jacob Reeper, vice president of legislative and political affairs for the group.

“He has literally turned millions and millions of gun owners into criminals with the passage of that law,” Reeper said.

Reeper said the tighter restrictions are not clear for owners who possess guns that are now illegal. He believes a lawsuit is likely.

“Success would be all, or most, of Cuomo’s gun laws struck down,” he said.

Earlier this month, Cuomo signed the toughest gun control law in the nation and the first since the Sandy Hook Elementary School Massacre in Newtown, Conn.

Under prior state law, assault weapons are defined by having two “military rifle” features spelled out in the law. The new law reduces that to one feature and include the popular pistol grip.

It also forces gun owners to renew their licenses every five years, stiffens penalties for using a gun in the commission of a crime and for bringing a gun on school property.

"We're going to stand here answer questions. This is not a public debate. This is to answer individual questions," Green said before heading into the question-and-answer portion of the presentation.

At the meeting,  Green and Hogan spent about 20 minutes explaining the various components of the law.

For example, Green explained that owners of assault weapons have until April 2014 to get those weapons registered.

"The registration is intended to be a quick, simple, and free process. Starting on April 15, 2013, the registration will start and you'll have one year if you have a weapon that's now classified as an assault weapon to register that weapon. It'll be free of charge and will capable of being done online.

State officials also handed out fact sheets about the gun control  -- including the provision that says only magazines that contain seven rounds or less will be sold in New York.

Some of the gun owners who attended the information session called for legislators to repeal the law, and some heckled state officials during the presentation

The meeting is part of an outreach effort to inform gun owners about the details of the new law.

Last week, the state launched a website and telephone hotline to help answer questions about the law.

The website includes a list of frequently-asked questions about the law, photos of weapons, and banned features, a list of banned weapons and firearms not considered assault weapons.

Here's the State's Information Site, for gun owners who have questions about the new law.

Who do you think you are?
It is my right to own any gun I want and not the government to tell me what I can own.

He is lucky he didn't get tarred and feathered
Judging from the reaction of people to the new laws there will be mass non compliance. When guns that were lawfully purchased years ago become illegal as purchased there is a big problem. All the smoke and mirrors nanny laws do nothing to stop a criminal but do infringe on the rights of the law abiding. What part of "SHALL NOT BE INFRINGED" escapes the Albany crowd? Maybe the next time the crowd won't be as polite and the guy may need his suit cleaned from being pelted with rotted produce and eggs or worse.

Interesting WBEN listener poll today.
As of 11:45 AM, a full 70 per cent of WBEN listeners' biggest fear about massacre-reducing proposals is that "They'll (guns) be taken away!" which of course is complete and absolute nonsense. Where do they get such beyond-the-pale misinformation?

Gabby Giffords testified today against school massacres.
Are you Adam Lanza / Jared Laughner / James Holmes apologists going to heckle her too?

They didn't (weren't capable of giving us) answer(s), when we asked. All the did was recite the "NYS Safe Act" from a piece of paper they handed out to us. Worst Info meeting I ever attended in my life. I was a law abiding NY resident and with these changes I'm now a common criminal. Thank You to the "Politicians that voted and enacted this bill". I'LL REMEMBER who not to vote for come election time.

Yes, I would
Heckle any tragedy driven calls for more government intervention. Life is never going to be completely safe, something far too many liberals seem fundamentally incapable of understanding. There will always be evil people who will find ways to hurt others. Taking away the freedoms of otherwise law-abiding, peaceful citizens will never stop that. The only thing removing guns from the average citizen accomplishes is to enable dictatorial government. The degree to which this county has sold away our rights to privacy and our freedoms in the search for a completely false security over the last generation is just pathetic and disgusting.

Response To Interesting WBEN listener poll
Oh, I don't know, maybe when Cuomo said that confiscation was still an option leading up to the passage of these new laws. Or maybe that one of the rejected Democrat proposals was the confiscation of all assault weapons. Or maybe when Cuomo proposed a two gun limit for all households for this new legislation but was rejected. So, call me paranoid then. But as you can see, if these law makers get their way, we all know what they really want to do.

gun control
doesn't the law realize that only honest people will follow the rules, not the criminals. If someone wants to hurt people they will find a way,and it doesn't have to be an assault rifle,it could be anything from a gas bomb to a couple of shotguns.I'll follow the law but I don't agree with it.

WBEN needs to start delivering the facts...
When your own poll shows that your listeners think that guns are going to be confiscated, don't you think that as a news station, you need to start reporting that this is not correct? Or would that be bad for ratings? You are marginalizing the station when the only voices heard are kooks from the (small) minority fringe.
01/31/2013 10:32PM
One might
Also find these sudden efforts at gun control more believable if the people involved ever even mentioned the near constant slaughter of youth in urban gang crime. Exactly what effect are more burdens on legal gun owners going to have on that? Why is one school massacre of suburban kids a national call to action, but dozens can die on any given weekend in Chicago or LA and no one cares?

I guess the Newtown Board of Ed are bloody terrorists also because they agreed with Wayne. They want armed security in their schools.
