(WBEN) -- The first person charged under New York's SAFE Act will not face jail time.
Benjamin Wassell, 33, of Chautauqua County, was convicted on three felony weapons charges under the state's harsher gun control law -- charges which could have elicited a jail sentence.
Instead, the Silver Creek man and Iraq war veteran was sentenced to five years probation in Erie County Court Friday.
Wassell twice sold illegal firearms to an undercover police officer and was convicted in March of possession of an illegal firearm, sale of a firearm and possession with intent to sell. The incidents came very shortly after the SAFE Act's implementation in January 2013. He asked the judge for leniency to be able to continue providing for his family, saying he was misled by a firearms dealer.
