Cheektowaga, NY (WBEN) One person has been shot, and another is in custody after a shooting outside the Dollar General at Union and French in Cheektowaga Tuesday afternoon.

Cheektowaga Police have identified the suspect as Travis Green, 29, of Garden Village Drive in Cheektowaga.

Green was charged with criminal use of weapon, intent to murder, resisting arrest, and other related charges. He pleaded not guilty in Cheektowaga Town Court Wednesday morning.  Bail was denied.

"It is a miracle I'm not at this podium reading the names of the dead," says Cheektowaga Police Chief David Zack, who added that dozens of rounds were fired during the incident and Green  was wearing body armor.

"Two AR-15 rifles were recovered. We may believe other weapons may be within the vehicle used by the suspect," says Zack. "... This appears to be an unprovoked attack, an attack where possibly dozens of rounds were fired."

Witnesses assisted police in tracking down the suspect, Zack said in a late afternoon news conference, (Hear it below)

"The first officers at the scene encountered total chaos," Zack said.  "Witneeses alerted officers to a man wearing camouflage leaving the scene on foot. The subject was repeatedly ordered to stop and refused. After a brief foot pursuit, the suspect was tackled to the ground by officers," says Zack, who adds no shots were exchanged between the suspect and officers.

The shooter is not cooperating with police and at first his identity was not even verified.  Police have not made his name public.

A 53 year old Cheektowaga man is the victim in the incident and remains in the hospital undergoing treatment for non life-threatening injuries.

The incident forced the closure of Union from Clinton to French for a couple of hours during the afternoon rush hour. Zack says there was initial confusion over the exact location of the Dollar General. "There are six Dollar General locations within our town. We were able to ascertain it was the Dollar General on Union Road," says Zack, but there are two on Union Road, one at the Airport Plaza, the other at Union and French. The official address is 25 Gardenville Parkway West, complete opposite directions.
