Joel Daniels says he wants the jury to be allowed to consider a charge of leaving the scene of a property damage accident instead of leaving the scene of an accident causing death. Daniels says jurors should also be allowed to consider drunken or impaired driving in lieu of second degree vehicular manslaughter charges. Daniels declined to have the jury look at a lesser charge of criminally negligent homicide as opposed to second degree manslaughter.
The jury gets the case after closing arguments Tuesday.
