BUFFALO, N.Y. (AP) - A Buffalo man has been sentenced to 30 days in jail and 1,000 hours of community service for stealing more than $50,000 from a trust established to pay a terminally ill cancer patient's medical expenses.
Scott Huber also must write letters of apology to victim Mary Tomaselli's family. The Buffalo restaurateur died last year.
Huber was sentenced Tuesday in Erie County Court, where he pleaded guilty last month to second-degree grand larceny. His lawyer, Andrew LoTempio, says the 36-year-old was having financial difficulties and had planned to replace the money he took before getting caught. He says he's paid back most of it.
Prosecutors say Huber used the money to establish his own insurance agency and install a heated sidewalk in front of his office.
