Judge Upholds Arbitrator's Ruling in Teacher Transfer Dispute



Buffalo, NY (WBEN) The Buffalo Teachers Federation received another judgement in its favor Tuesday when a judge upheld an arbitrator's ruling involuntary teacher transfers violated the Buffalo Public Schools' contract with the union.

"We're obviously pleased and vindicated," says BTF President Phil Rumore. "By the board's appealing the (arbitrator's) decision and trying to have it vacated, as far as the teachers are concerned, it's another slap in the face. They agreed to go to arbitration, now they don't like the decision and they're going to try and have it overturned. It's one more thing the teachers will be angry about."
The arbitrator's ruling found while the contract doesn't ban involuntary transfers entirely, some aspects of the way the district did them violated the contract.

Rumore says whether the board appeals will be up to board members. The next meeting is set for September 26th. Whalen denied an injunction stopping the transfers, allowing the district to either appeal or honor the ruling.
