Amherst, N.Y. (WBEN) - A Niagara Falls man has been arraigned after his motorcycle hit and killed two people walking along a bike path, and injured a third person.
Amherst Police say David Smith, 53, is charged with driving while intoxicated and criminally negligent homcide following the Sunday afternoon incident.
Police says Smith's motorcycle swerved off Tonawanda Creek Road on a curve. The bike then struck and killed Sheila Pelton, 81, of East Amherst and Jocelyn Elberson, 25, of Tonawanda.
Pelton's husband, 79-year-old Foster Pelton, was hospitalized but is expected to survive.
Smith is recovering at ECMC with injuries not believed to be life-threatening.
Amherst Police Captain Patrick McKenna says Smith has a court appearance scheduled for Thursday afternoon at 1 p.m.
