3 Strikes for DWI? DMV Has New Regulations for That



Buffalo, NY (WBEN) After learning the suspect in Sunday's deadly crash along an Amherst bike path had been convicted of DWIs previously, some are wondering what it takes to permanently revoke a driver's license. The DMV recently enacted regulations that could do just that.

In September, New York State introduced regulations aimed at keeping dangerous drivers off the road.

Among the provisions:
  • Lifetime Record Review by DMV
    DMV will be able to review the lifetime record of all drivers who apply to have a license reinstated after a revocation.
     
  • Truly Permanent License Revocation for Persistently Drunk & Dangerous Drivers
    After conducting a lifetime record review, DMV will deny any application for reinstatement of a license after revocation if the applicant has:
    o Five or more alcohol or drug related driving convictions in his or her lifetime
    or
    o Three or more alcohol or drug related driving convictions in the last 25 years plus at least one other serious driving offense during that period. A serious driving offense includes: a fatal crash, a driving-related penal law conviction, an accumulation of 20 or more points assessed for driving violations within the last 25 years, or having two or more driving convictions each worth five points or higher.
     

Deanna Russo, founder of Crusade Against Impaired Driving, says the new regulations "would be effective on repeat drunk drivers," saying many of the offenders are repeat. But there is another danger. "There are a lot of drunk drivers who don't have a license, so there would need to be more penalties to this," adds Russo.

She adds th state will have to be effective in keeping track of all those who have been convicted at DWI. She also believes the combination of close monitoring, ignition interlocks, and license revocation will also keep drunk drivers off the road.
