Both charges carry similar amounts of jail time. A former prosecutor spoke with WBEN about the penalties for crimes involving dogs or cats -- as opposed those with human victims.
Buffalo Police have charged two teens -- Diondre Brown, 17, and Adell Ziegler, 19 -- both of Buffalo with a felony count of aggravated animal cruelty. Authorities say the charge carries up to four years in prison on a conviction.
That amount is similar to the penalty for criminally-negligent homicide -- one of the charges against the motorcyclist, David Smith of Niagara Falls, in the fatal bike path accident Sunday in Amherst.
Former Erie County District Attorney Frank Clark says that charge -- combined with the DWI charge -- and he says the chances "of getting less than four years in jail, to me ... it's not going to happen," Clark says.
Clark sees potential jail-time of between four and seven years for that offense, he says.
