Falls Man Admits to Deadly DWI Crash



Buffalo, NY (WBEN) A Niagara Falls man has pleaded guilty to his role in a deadly Veteran's day crash.

53 year old David Smith pled guilty to first degree vehicular manslaughter, second degree vehicular assault, and DWI.

The DA's office says those are higher charges than the ones initially filed.

Smith admitted to driving drunk on Tonawanda Creek Road in Amherst, losing control of his motorcycle going off the road and causing the deaths of 26 year old Jocelyn Elberson and 81 year old Sheila Pelton, and seriously injured 79 year old Foster Pelton.

Smith faces 15 to years to life when sentenced in March.
