Parete Death Classified as Homicide



Buffalo, NY (WBEN) Buffalo Police would not comment on a next step after the Erie County Medical Examiner's office classified the death of Buffalo Police Officer Patty Parete a homicide.

Parete was paralyzed after she and Officer Carl Andolina were shot in the line of duty in downtown Buffalo in December 2006. Andolina was wounded three times.

Parete died early Saturday morning in her home in Niagara County.

Any decision to pursue a murder charge against the gunman, Varner Harris, Jr. would be up to Erie County DA Frank Sedita. Harris is serving a 30 years to life sentence for the shooting.
A funeral for Parete will be held Wednesday at Trinity Episcopal Church in downtown Buffalo.
Sedita says he's not ready to make a decision on whether to do so. "(Harris) has appealed four times and lost, the latest on the federal level," says Sedita. "If I want to retry him, I may have to revoke all that and start all over again, knowing I take the chance he gets out of jail, knowing he's at least behind bars until 2037. Having not yet talked to the surviving members of the Parete family, I'm not going to make a decision on this case yet."
