Published reports say John Elmore plans to file papers against the hospital on behalf of a client who claims to have been infected with hepatitis after being injected with another person's insulin pen.
Olean General Hospital is responding, saying distorted numbers are being offered to the public, and billboards have gone up by attorneys to have patients contact them even if tests came up negative.
The hospital says it came forward on its own in informing 19 hundred patients, and no patient has been identified as receiving an injection from another patient's pen.
The hospital believes the possibility anyone contracted an infection from an insulin pen was extremely remote.
If there are positive results, attorneys are trying to link them to the use of insulin pens at the hospital.
The hospital says that connection is almost impossible to determine.
