Attorney: Nix Pranksters Could Face Charges



Buffalo, NY (WBEN) A prank on a friend is one thing, but a prank on a high profile football manager could mean legal trouble, so says one legal expert.

Attorney Joe LaTona says the two pranksters can be charged for illegal wiretapping. "The federal and state law indicate any third who listens in on two other people's phone conversation without the consent of either is guilty of illegal wiretapping or eavesdropping," explains LaTona. He emphasizes it would be a different story if one of the participants gives the ok. "One individual consenting would take it out of the illegal area," says LaTona.

Why would anyone do this? "I haven't a clue," says LaTona. "You'd think people would have better things to do than orchestrate anything of this kind."  He says it could be someone harassing people to enjoy a level of prominence in the community.

LaTona says in addition to criminal charges, the pranksters could face a civil lawsuit.
