Buffalo, NY (WBEN) The man accused of fatally stabbing a Toys R Us manager has been indicted.
The attorney for Bernie Gruzca says he received an affidavit from the district attorney's office Grucza was indicted. This makes an additional Hamburg court appearance unnecessary and Frank Housh anticipates an arraignment for his client next week.
"My client's staying strong, it's obviously traumatic for all involved," says Housh. "Not just for the victim's family, but for my client, who's facing serious allegations. My client didn't commit this crime, we intend to defend him and we expect he'll be vindicated at trial."
Housh says he's also concerned about his client's ability to get a fair trial. "It's a concern especially when you have police officers offering medical opinions about specific pathologies my client they allege have. I understand police will talk about the case but they should keep their comments limited to the nature of the investigation and to the facts. Instead, they've been offering medical opinions that may make it difficult for me to get an impartial jury," notes Housh.
Gruzca is being held without bail at the Erie County Holding Center.
