Buffalo, NY (WBEN) Carl Paladino's bid to have this past year's votes from Buffalo School Board President Barbara Seals Nevergold invalidated has been rebuffed.
Judge Tracey Bannister says a similar complaint by Paladino was rejected by the state education department.
She adds Paladino could have brought the matter up before last year's Buffalo School Board elections.
Paladino had contended Nevergold was required to run in 2013, two years after being appointed to fill the seat vacated by Chris Jacobs.
Bannister says since she legally held the seat and was not required to run, her right to vote remains intact.
