Conflicting Reports on McKelvin Situation

Buffalo, NY (WBEN)- After telling reporters at Ralph Wilson Stadium Wednesday that he "didn't want anybody to be arrested," Erie County District attorney Frank Sedita tells WBEN that he has a sworn affidavit from Leodis McKelvin saying he would like to press charges.

This morning, McKelvin's agent Hadley Engelhard told WBEN he is unaware of his client signing any such document and re-iterated that his client would NOT be pursuing charges in the matter.  Engelhard added that at this point, McKelvin would just prefer that the issue disappear.

The front lawn of the Bills Kick Returner was vandalized early Tuesday morning by two 16 year olds using spray paint. They admitted their guilt to Hamburg Police Wednesday. McKelvin told reporters that "he was mad in a way, but laughing in a way,"  didn't want the perpetrator arrested, and that he wanted this sort of behavior to stop.

Thursday, Sedita told WBEN that his office continues to investigate, and charges against the two 16 year olds could be forthcoming, pending the outcome of that investigation.

Any charges would likely be misdemeanors.   Local Defense Attorney Terrence Connors tells WBEN that should the charges be pursued, they'd likely be handled within the confines of family court, and "that would make it a confidential proceeding.

Sedita says any decision on whether or not to prosecute won't come until the investigation is completed.
