Buffalo, NY (WBEN)- There will be no criminal charges for the 16 year olds who admitted to vandalizing the lawn of Buffalo Bills Kick returner Leodis McKelvin following last Monday's loss to the New England Patriots.
Erie County District Attorney Frank Sedita issued a statement saying, in part, "based upon the wishes of the victim, the nature of the offenses, the age of the offenders, their lack of a criminal record, their remorse, their willingness to each perform 120 hours of community service, and upon the consultation with the Town of Hamburg Police Department, criminal prosecution is presently declined."
The statement goes on to say that the decision to decline prosecution could be revisited if the two get into any more trouble, or fail to perform the community service.
McKelvin was injured in the sceond half of the Bills/Buccaneers Game Sunday. There is no update on his condition at this point.
